Locating Commonwealth Acts

Note: All titles are held in both Townsville and Cairns unless otherwise indicated. Cairns holdings of some serial titles may be incomplete.
1. Check the consolidated or reprinted acts at TVL 348.94023 P2 for the latest reprint of the act, or access the electronic version at http://www.austlii.edu.au/au/legis/cth/consol_act/

A reprinted act incorporates all amendments made to the act, up to the date of reprint. Not all acts are reprinted.

2.

If no reprint is available, locate the act in the appropriate annual volume of acts at 348.94022 P1, or at http://www.austlii.edu.au/au/legis/cth/num_act/

3. Tables of Acts 1901-1991 (348.94022 P1) or the Federal Statutes Annotations (348.94026 P1) may be helpful in establishing the date of an act, if this is unknown.
4. Wicks Subject Index to Commonwealth Legislation (348.94026 P2) may be of assistance if the title of an act is unknown.

"Updating" Commonwealth Acts

Having located an act of parliament it is generally important to check whether the act, or any parts of it, have been repealed or amended.  This procedure is sometimes referred to as "updating" or "noting up" the act.

The following steps should be taken to check for alterations to a Commonwealth act:

1. Check:

Federal Statutes Annotations                                                                        348.94026 P1

Federal Statutes Annotations: Supplement                                                    348.94026 P1

Federal Statutes Annotations: Repealed Legislation                                    348.94026 P1 (A)

This work lists Commonwealth acts alphabetically by title. Under the title of each act are listed amendments or repeals made since the latest reprint of the act.

2. Check the most recent issue of Australian Current Law: Legislation (TVL 348.94026 P8) under "Cumulative table of amended acts"

OR

Check the most recent issue of Australian Legal Monthly Digest (TVL 348.94026 P6) under "Alpahabetical table of acts passed, amended, repealed or proclaimed to commence".

These monthly publications will indicate any very recent changes to the legislation.
